Ontario provides a subsidized family mediation program for anyone separating or divorcing, with costs based on a sliding scale tied to income. For those involved in court cases, parties can receive two hours of free on-site mediation at the courthouse, and all participants can access subsidized off-site mediation regardless of their court status. Fees for the off-site service can be as low as $5 per hour, determined by your income and number of dependent children.
On-site mediation through the court:
Cost: Two hours are free for parties involved in a court case.
Availability: Offered at family court locations in Ontario, including the Ottawa courthouse and Cornwall courthouse.
How it works: A mediator meets with parties on the day of their court appearance to help resolve issues related to children, such as custody, access, and child support.
Off-site mediation, outside of court:
Cost: A sliding scale fee based on your family's income and number of dependents. Fees can start as low as $5 per hour.
Availability: Available to everyone, whether you are in court or not.
Once we have received the application forms, each party will receive a request to book their free one-hour intake meeting with a mediator. This one-on-one meeting is where you will discuss your side of the negotiation. Fees for the mediation are charged based on each person’s income and number of dependants. You will need to provide proof of your income, such as: your most recent income tax return or a pay stub.
After both intake meetings, the mediator will determine if mediation is the right course of action. If the mediator determines mediation is appropriate, they will schedule up to 6 hours of subsidized mediation.
We encourage all clients to obtain legal advice before, during, and after all mediations.
How to access the off-site Mediation program:
Complete the application below on our website and email it to us, or complete it / bring it in person to one of the Family Information Resource Centres if you reside in the regions listed below.
Important considerations: Mediation is voluntary. The program may not be suitable if there is a history of family violence or serious mental health or substance abuse issues.
